1. Acceptance of Terms

By accessing or using NotHere (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and NotHere.

2. Description of Service

NotHere provides a privacy-focused VPN Chrome extension that encrypts your internet traffic and routes it through our secure servers. The Service is available in two tiers:

• NotHere Free: Access to basic VPN functionality with a limited selection of server locations
• NotHere Premium: Enhanced features including all global server locations, premium routes, priority speeds, and advanced protection, unlocked through Web3 token ownership

3. Eligibility

You must be at least 18 years old to use the Service. By using NotHere, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Premium Access and Token Gating

NotHere Premium is unlocked through ownership of designated Web3 tokens ("Access Tokens"). By participating in the Premium tier:

• You must connect a Web3 wallet and hold the required Access Tokens
• Premium access is verified through blockchain integration and does not require additional payment beyond token acquisition
• Access Tokens are subject to availability and market conditions; NotHere does not control token pricing or availability
• Loss or transfer of Access Tokens will result in loss of Premium access
• NotHere is not responsible for the security of your wallet or tokens

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to engage in illegal activities, including but not limited to hacking, fraud, or distribution of illegal content
• Violate any local, national, or international laws
• Attempt to circumvent, disable, or interfere with the Service's security features
• Use automated systems (bots, scripts) to abuse or overload the Service
• Share your account or Premium access with others
• Reverse engineer, decompile, or disassemble any part of the Service

Violation of this policy may result in immediate termination of your access to the Service.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. We operate a strict no-logs policy and do not track, store, or monitor your browsing activity. Please review our Privacy Policy for details on how we handle data.

7. Service Availability

We strive to provide uninterrupted service, but we do not guarantee that the Service will always be available, error-free, or secure. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any interruption or termination of service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NOTHERE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOTHERE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO ACCESS THE SERVICE IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify, defend, and hold harmless NotHere, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of use of any third-party sites. Your interactions with third parties are solely between you and the third party.

We may terminate or suspend your access to the Service at any time, with or without cause or notice, for any reason including violation of these Terms. Upon termination, your right to use the Service immediately ceases.

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in the United States.
